Alteration to the contract

  • The tenant company must negotiate a new altered contract with the managing agency should they wish to alter any of the following from the tenancy contract
    • Name of the company or representative (in the case of representative’s name, only upon a request from the corporation)
    • Type of business and activities
    • The site size (in case of plant site, following site sizes are excluded)
      • Person who tried to change it should operate the plant
      • The change in size must be within 20 percent of the plant site size agreed in the initial tenancy agreement
      • The plant area ratio after the alteration must fit with the standard plant area ratio
    • Construction area(in case of plants, treated the same as the site size alteration case)

Tenancy eligibility

  • The enterprise must be required for supporting the industry, targeted for tenancy, and facility according to the appropriate industrial complex’s general management planning, or for assisting other tenant companies. Must be either able to or have already, attain approval/authorization for the implementation of the business plan from the authorities.

Tenancy through auction

  • According to the regulations in the auction laws, the party who has acquired the tenant company’s industrial site or plant, must agree on tenancy with the managing agency within 6 months from the acquisition date. However, should they fail to reach a tenancy agreement, the acquisition must be transferred to a third party within 1 year from the end of 6 months period.

Tenancy through acquisition by transfer

  • Disposal of the companies that have already completed the plant construction
    • Should a tenant company wish to get disposed of its industrial site and plant after the completion of its plant construction, it must notify the appropriate authorities as stated by the presidential decree.
    • Disposal notice
      • A copy of the contract on the transfer
      • Business plan of the recipient in the transfer
      • Certified copies of the registration on the land or the building
  • Disposal of the companies before the completion of plant construction
    • Should a tenant company wish to get disposed of its industrial site and plant before the completion of its plant construction, it must transfer its ownership to the managing agency. However, should the managing agency incapable of this purchase, the managing agency will seek acquisition applications from other companies or related institutions and choose the recipient of the transfer. Should a tenant company wish to get disposed of its industrial site or plant, it must submit the Disposal notice with required documentation as stated by the Ministry of Commerce’s decree to the authorities in advance.
